These Terms and Conditions govern access to and use of EzzyPark, an online parking-booking platform powered by Ezzy.ph.

By accessing the EzzyPark website, mobile application, booking system, or related services, you confirm that you have read, understood, and agreed to these Terms and Conditions. If you do not agree, you must not use the platform.

These terms should be reviewed by a Philippine lawyer before publication. Online platforms in the Philippines remain subject to consumer-protection, e-commerce, privacy, and Internet-transaction laws, and a disclaimer cannot remove responsibilities that the law places directly on EzzyPark.

1. About EzzyPark

EzzyPark provides an online platform through which customers may:

  • Search for participating parking locations;
  • View parking-space information and available schedules;
  • Select a parking date and time;
  • Submit vehicle and booking information;
  • Pay applicable parking charges and platform fees; and
  • Receive booking confirmation.

Parking spaces and parking-related services displayed on EzzyPark are offered and managed by independent third-party parking owners, operators, property managers, establishments, or other service providers, collectively referred to as “Providers.”

Unless expressly stated otherwise, EzzyPark does not own, operate, manage, inspect, supervise, secure, or control the parking facilities listed on the platform.

2. Definitions

For these Terms:

“Customer” means a person who searches for, books, pays for, accesses, or uses a parking service through EzzyPark.

“Provider” means an independent person or entity that lists or provides parking spaces or related services through EzzyPark.

“Booking” means a confirmed request for a parking space for a specified location, date, time, duration, and vehicle.

“Platform” means the EzzyPark website, mobile application, booking system, payment interface, and related technology.

“Parking Service” means the use of a parking space and any related service supplied by a Provider.

3. Eligibility

You may use EzzyPark only if you:

  • Are at least 18 years old;
  • Have legal capacity to enter into a binding agreement;
  • Provide accurate and complete information;
  • Use a legally registered and roadworthy vehicle where required; and
  • Comply with these Terms and all applicable laws and parking-facility rules.

A parent, guardian, company representative, or authorised adult who makes a booking for another person is responsible for ensuring that the actual driver or user complies with these Terms.

4. User Accounts

Certain features may require an account.

You are responsible for:

  • Keeping your login credentials confidential;
  • Preventing unauthorised access to your account;
  • Maintaining accurate contact, vehicle, and payment information;
  • Reviewing activity conducted through your account; and
  • Informing EzzyPark promptly of suspected unauthorised use.

EzzyPark may suspend or restrict an account where there is suspected fraud, misuse, false information, security risk, repeated non-payment, policy violation, or unlawful activity.

5. Platform-Only Role

EzzyPark acts as a technology platform and booking intermediary between Customers and independent Providers.

A confirmed Booking creates an arrangement for the Parking Service between the Customer and the relevant Provider. EzzyPark is not the employer, agent, partner, joint venturer, insurer, landlord, bailee, security provider, or representative of either party, except to the limited extent expressly stated in writing.

Providers independently determine or control matters such as:

  • Parking-space availability;
  • Facility access and opening hours;
  • Vehicle restrictions;
  • Parking rates;
  • On-site procedures;
  • Security measures;
  • Facility condition;
  • Staff conduct;
  • Entry and exit requirements; and
  • Performance of the Parking Service.

Nothing in these Terms excludes legal duties that apply directly to EzzyPark as an online platform under Philippine law. The Internet Transactions Act regulates online merchants and digital platforms and provides protections for consumers engaging in Internet transactions.

6. Parking Listings

Providers are responsible for ensuring that their listings are accurate, lawful, current, and not misleading.

A listing may include:

  • Location and access instructions;
  • Available dates and hours;
  • Parking-space dimensions;
  • Vehicle restrictions;
  • Rates and additional charges;
  • Facility rules;
  • Photographs;
  • Security information; and
  • Cancellation or refund conditions.

EzzyPark may review, edit, suspend, or remove a listing when necessary, but does not guarantee that every listing has been independently inspected or verified.

Customers must review the complete listing before making payment.

7. Bookings

A Booking is confirmed only after:

  1. The Customer submits the required information;
  2. The selected space and schedule remain available;
  3. Payment is successfully completed or otherwise authorised; and
  4. EzzyPark issues a booking confirmation.

Adding a space to a cart, opening a payment page, or receiving a pending-payment notice does not guarantee availability.

The booking confirmation should be checked immediately. The Customer must report incorrect booking details promptly.

8. Prices, Charges and Taxes

Parking rates are generally set by Providers and may vary according to:

  • Location;
  • Day and time;
  • Duration;
  • Vehicle type;
  • Demand;
  • Special events;
  • Facility type;
  • Additional services; and
  • Provider policies.

Before payment, EzzyPark will display the applicable amount, which may include:

  • Parking charges;
  • EzzyPark platform or service fees;
  • Payment-processing charges;
  • Taxes;
  • Overtime charges;
  • Administrative fees; and
  • Other clearly disclosed charges.

Customers must review the final amount before confirming payment.

9. Payments

Payments may be processed by third-party banks, e-wallets, card networks, or payment gateways.

By submitting payment, the Customer:

  • Authorises the applicable amount to be charged;
  • Confirms authority to use the selected payment method;
  • Agrees to the payment provider’s terms; and
  • Accepts that transaction approval may depend on the payment provider.

EzzyPark is not responsible for delays, declined transactions, outages, duplicate authorisations, or other problems caused solely by a third-party payment provider. EzzyPark will nevertheless provide reasonable assistance where a transaction processed through the platform requires investigation.

Electronic transactions and records are recognised under the Philippine Electronic Commerce Act.

10. Customer Responsibilities

Customers must:

  • Provide the correct vehicle plate number and vehicle details;
  • Arrive within the booked schedule;
  • Park only in the assigned or authorised area;
  • Follow all signs, instructions, traffic rules, and Provider policies;
  • Keep access codes, QR codes, tickets, and booking credentials secure;
  • Avoid blocking driveways, exits, emergency lanes, or other vehicles;
  • Remove the vehicle by the end of the booked period;
  • Pay overtime or additional charges where applicable;
  • Avoid unlawful, dangerous, disruptive, or abusive conduct; and
  • Respect Provider personnel, property, and other users.

A Provider may deny entry or require removal of a vehicle that is unsafe, incorrectly registered, oversized, unauthorised, illegally parked, or otherwise non-compliant.

11. Provider Responsibilities

Providers must:

  • Have the right and authority to offer the listed parking spaces;
  • Maintain accurate availability and pricing;
  • Honour confirmed Bookings except where cancellation is reasonably necessary;
  • Provide safe and lawful access consistent with the listing;
  • Clearly disclose material restrictions and charges;
  • Comply with applicable permits, licences, tax obligations, safety rules, and consumer laws;
  • Protect Customer information;
  • Respond reasonably to booking issues and complaints; and
  • Avoid false, misleading, discriminatory, abusive, or unlawful conduct.

Providers are independently responsible for the Parking Services they supply.

12. Arrival, Access and Late Entry

Customers should arrive within the time stated in the Booking.

Access may require:

  • Showing the booking confirmation;
  • Scanning a QR code;
  • Entering a booking number;
  • Presenting the registered vehicle;
  • Collecting a ticket; or
  • Following instructions from facility personnel.

Late arrival does not automatically extend the booking end time or entitle the Customer to a partial refund.

EzzyPark and the Provider do not guarantee that a late Customer can be accommodated beyond the reserved schedule.

13. Overtime and Extended Parking

A Customer who remains beyond the booked period may be charged:

  • An hourly overtime rate;
  • The Provider’s prevailing drive-in rate;
  • An extension fee;
  • A penalty disclosed in the listing; or
  • Other reasonable charges resulting from the overstay.

Extensions are subject to availability and are not confirmed until approved through the platform or by the Provider.

Unauthorised overstaying may result in towing, wheel clamping, access restriction, account suspension, or other lawful action. The Customer is responsible for resulting costs where legally permitted.

14. Cancellations, Changes and Refunds

Bookings are subject to the separate EzzyPark Refund and Cancellation Policy, which forms part of these Terms.

Refund eligibility may depend on:

  • Time remaining before the Booking;
  • Provider cancellation rules;
  • Whether the space was used;
  • The reason for cancellation;
  • Payment-processing status;
  • Promotional conditions; and
  • Whether the Provider failed to supply the confirmed Parking Service.

Refunds are not automatically available for:

  • Customer no-shows;
  • Late arrival;
  • Incorrect date, location, or vehicle information entered by the Customer;
  • Failure to follow access instructions;
  • Change of personal plans;
  • Removal of a vehicle for violating facility rules; or
  • Events outside EzzyPark’s reasonable control, except where applicable law requires otherwise.

Nothing in the refund policy limits mandatory consumer remedies. DTI advises online consumers to review platform cancellation and refund policies before completing transactions.

15. Provider Cancellations and Unavailable Spaces

A Provider may occasionally be unable to honour a Booking because of closure, emergency, equipment failure, incorrect availability, safety issues, or other operational problems.

Where a confirmed space is unavailable, EzzyPark may, where reasonably possible:

  • Contact the Customer;
  • Help identify a comparable alternative;
  • Reschedule the Booking;
  • Issue platform credit with the Customer’s agreement; or
  • Process an eligible refund.

These remedies do not remove rights available under applicable law.

16. Vehicle Loss, Theft and Damage

Unless a Provider expressly offers a documented valet, custody, or insured parking service, parking is generally provided on a self-park basis.

Customers remain responsible for:

  • Locking their vehicles;
  • Closing windows;
  • Safeguarding keys;
  • Removing or securing valuables;
  • Activating security systems; and
  • Following facility safety procedures.

To the fullest extent legally permitted, EzzyPark is not responsible for theft, loss, vandalism, collision, flooding, fire, falling objects, natural events, or vehicle damage occurring at a Provider’s facility when the event is caused by the Provider, another user, a third party, the Customer, or circumstances outside EzzyPark’s direct control.

Any incident should be reported immediately to the Provider, relevant authorities, insurer, and EzzyPark support.

This clause does not exclude liability that cannot lawfully be excluded, including liability arising from EzzyPark’s own fraud, wilful misconduct, or other directly imposed legal responsibility.

17. Safety and Security

Information regarding guards, CCTV, barriers, lighting, access control, or other security features is provided for general reference and does not guarantee that a vehicle, person, or property will be completely secure.

Customers must assess whether a parking location is suitable for their circumstances.

In an emergency, contact local police, emergency services, facility security, or other competent authorities before contacting EzzyPark support.

18. Prohibited Activities

Users must not:

  • Submit false identities, vehicle details, listings, or documents;
  • Use stolen or unauthorised payment methods;
  • Manipulate prices, bookings, reviews, or availability;
  • Resell or transfer a Booking without permission;
  • Bypass EzzyPark to avoid disclosed platform charges after finding the Provider through the platform;
  • Upload malware or interfere with platform security;
  • Scrape, copy, reverse-engineer, or misuse platform data;
  • Harass, threaten, discriminate against, or harm another person;
  • Use the platform for unlawful parking, storage, transport, or commercial activity;
  • Publish defamatory, fraudulent, obscene, or infringing content; or
  • Violate applicable laws or third-party rights.

19. Reviews and User Content

Users may be allowed to submit reviews, photographs, comments, messages, or other content.

Users retain ownership of their original content but grant EzzyPark a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, format, and use that content for platform operation, moderation, promotion, and improvement.

Content must be truthful, relevant, lawful, and based on genuine experience.

EzzyPark may remove content that is:

  • False or misleading;
  • Abusive or discriminatory;
  • Unrelated to the Booking;
  • Promotional spam;
  • Infringing;
  • Privacy-invasive; or
  • Otherwise contrary to these Terms.

20. Intellectual Property

The EzzyPark and Ezzy.ph names, logos, platform design, software, text, graphics, databases, and other proprietary materials are owned by or licensed to EzzyPark, Ezzy.ph, or their respective rights holders.

Users receive only a limited, revocable, non-transferable right to use the platform for legitimate personal or business-booking purposes.

No part of the platform may be copied, distributed, modified, sold, licensed, or commercially exploited without prior written permission.

21. Privacy

Personal information is processed in accordance with the EzzyPark Privacy Policy and applicable Philippine data-protection law.

The Data Privacy Act requires personal information held in private-sector information systems to be appropriately protected.

Customers acknowledge that necessary booking information may be shared with the selected Provider, payment processors, service providers, and authorities where legally required.

22. Third-Party Services and Links

EzzyPark may integrate or link to:

  • Maps;
  • Payment gateways;
  • Messaging services;
  • Social-media platforms;
  • Provider websites; and
  • Other third-party tools.

Third-party services are governed by their own terms and privacy policies. EzzyPark does not control and is not responsible for their independent content, availability, security, or conduct.

23. Platform Availability

EzzyPark aims to keep the platform available but does not guarantee uninterrupted, error-free, or continuously secure access.

The platform may be temporarily unavailable because of:

  • Maintenance;
  • Software updates;
  • Hosting failures;
  • Internet or telecommunications outages;
  • Cybersecurity incidents;
  • Payment-service outages;
  • Force majeure events; or
  • Circumstances outside reasonable control.

EzzyPark may modify, suspend, discontinue, or restrict features where reasonably necessary.

24. Disclaimer of Warranties

To the extent permitted by law, the platform is provided on an “as available” basis.

EzzyPark does not guarantee that:

  • Every listing will be accurate at all times;
  • Every Parking Service will meet a Customer’s personal expectations;
  • A facility will be completely safe or secure;
  • A Provider will always perform without delay or error;
  • The platform will always be uninterrupted; or
  • Every dispute between a Customer and Provider will be resolved by EzzyPark.

Nothing in this section removes statutory warranties, consumer guarantees, or remedies that cannot legally be waived.

25. Limitation of Liability

To the fullest extent permitted by applicable law, EzzyPark will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses arising from:

  • A Provider’s acts or omissions;
  • The condition or operation of a parking facility;
  • Theft, damage, injury, delay, cancellation, overbooking, or access failure;
  • Customer misuse or violation of facility rules;
  • Third-party payment or technology services; or
  • Events outside EzzyPark’s reasonable control.

Where EzzyPark is legally liable in connection with a Booking, its liability will be limited only to the extent permitted by law. No limitation applies where exclusion or limitation is prohibited, including where liability results from fraud, wilful misconduct, gross negligence, or a non-waivable consumer right.

The Consumer Act establishes consumer protections and standards of business conduct, so these Terms cannot validly remove mandatory rights granted by law.

26. Indemnity

To the extent permitted by law, a user agrees to reimburse EzzyPark for reasonable losses, liabilities, costs, or claims resulting from that user’s:

  • Breach of these Terms;
  • Unlawful conduct;
  • False or misleading information;
  • Misuse of the platform;
  • Infringement of another person’s rights; or
  • Damage caused to a facility, vehicle, person, or property.

This provision applies only to the extent the loss was caused by the relevant user and does not require a user to indemnify EzzyPark for EzzyPark’s own unlawful conduct.

27. Complaints and Dispute Assistance

Customers should first report a service issue to:

  1. The relevant Provider, where immediate on-site action is required; and
  2. EzzyPark support, with the booking number, photographs, receipts, messages, and other supporting details.

EzzyPark may facilitate communication and attempt to help the parties reach a practical resolution. However, EzzyPark is not a court, arbitrator, insurer, law-enforcement agency, or guarantor of Provider performance.

Users retain the right to contact the DTI, National Privacy Commission, local government, courts, law-enforcement authorities, or other competent agencies where appropriate.

28. Suspension and Termination

EzzyPark may suspend or terminate access where a user:

  • Materially breaches these Terms;
  • Engages in fraud or abuse;
  • Creates safety or security risk;
  • Repeatedly fails to pay applicable charges;
  • Misuses personal information;
  • Harasses Customers, Providers, or staff;
  • Uses the platform unlawfully; or
  • Exposes EzzyPark or others to legal or operational risk.

Termination does not affect obligations or liabilities that arose before termination.

29. Changes to These Terms

EzzyPark may update these Terms to reflect changes in:

  • Platform services;
  • Provider arrangements;
  • Payment processes;
  • Business practices;
  • Legal requirements; or
  • Consumer-protection standards.

The revised Terms will be posted with an updated date. Material changes may also be communicated through the website, application, email, or account notice.

Continued use after the effective date means acceptance of the updated Terms, except where renewed consent is legally required.

30. Governing Law

These Terms are governed by the laws of the Republic of the Philippines.

Any dispute that cannot be resolved informally may be brought before the courts or competent government agencies having jurisdiction under applicable law.

Nothing in this section prevents a consumer from exercising rights relating to venue, complaints, or remedies under mandatory consumer-protection rules.

31. Severability

If any provision is found invalid, unlawful, or unenforceable, that provision will be limited or removed only to the minimum extent necessary. The remaining provisions will continue to apply.

32. No Waiver

Failure by EzzyPark to enforce a provision immediately does not mean that EzzyPark has waived the right to enforce it later.

33. Entire Agreement

These Terms, together with the following policies, form the agreement governing use of EzzyPark:

  • Privacy Policy;
  • Refund and Cancellation Policy;
  • Provider terms, where applicable;
  • Listing-specific conditions; and
  • Other policies displayed during Booking.

Where listing-specific terms conflict with mandatory law, applicable law will prevail.
